UNCONTESTED DIVORCE
UNCONTESTED DIVORCE

An uncontested divorce is one where one party files for divorce with or without the knowledge of the other spouse. The party filing would be known as the Plaintiff in the documents and the other party would be known as the Defendant. Further, the Defendant would be personally served with the initiating court document called the Statement of Claim. With an uncontested divorce, the Defendant does not respond to the Statement of Claim by filing a Statement of Defence or Demand of Notice. The Plaintiff then proceeds with the remainder of the process on their own.

JOINT DIVORCE
JOINT DIVORCE

A joint divorce is one where both parties go before the court as husband and wife and apply jointly to dissolve their marriage (for a divorce). If you choose to go the route of a joint divorce, you are letting the court know that you and your spouse are in agreement regarding all the issues at hand related to your divorce. Further, both parties would be involved in every stage of the process and work together to obtain the final Divorce Judgment and Certificate of Divorce.

If you (or you and your spouse, jointly) attempted to file the divorce documents yourselves and you have received a Rejection Notice from the court, I am able to assist with correcting the errors and resubmitting the necessary documentation so that your divorce can be finalized.

AGREEMENTS
AGREEMENTS

My services include preparation of agreements such as Separation Agreements and Cohabitation Agreements. I meet with both parties and together we work towards an agreement that is amenable to both parties.

OTHER SERVICES RELATED TO DIVORCE AND FAMILY LAW

I am also available to assist with court documents for matters such as a Notice to Disclose/Notice of Motion applications, Substitutional Service applications, custody and access applications as well as child/spousal support applications. I can also assist with the court documentation in some contested divorces.

PROCESS SERVICE
REJECTION NOTICES

There are instances, particularly with uncontested or contested divorces, where proper service can be difficult to achieve. I do assist my clients with service of the Statement of Claim and that is included in my regular fees. However, when the individual who must be served is not cooperative extra fees may be applied (something I will discuss with the client).  I am also available to be hired by outside parties for strictly process service jobs.
