Wills

WILLS:

Having a proper Will in place is an important step in estate planning. The lack of a named Executor can make handling your affairs difficult for your family and you will have no say over how your estate will be distributed.  The Alberta Wills and Succession Act sets out the rules for the division of your estate. Your Last Will and Testament is a means by which you, as an owner of property, divides and disposes of your assets in the event of your death. It is a legal document that expresses your wishes as to how your property is to be distributed after your death and will also appoint the appropriate individual(s) to manage your estate and appoints guardians for your children when necessary.

PERSONAL DIRECTIVE AND ENDURING POWER OF ATTORNEY

Along with having a Will in place, an Enduring Power of Attorney and Personal Directive are important documents to also have prepared. If you somehow become incapacitated prior to your death, the Enduring Power of Attorney gives a trusted person of your choosing access to your financial assets and the power to make decisions about them. The Personal Directive gives a third party power to make decisions about your personal life – where you and how you live, your quality of life, and what kind of medical choices are made for you. The Enduring Power of Attorney and Personal Directive are legally written documents in accordance with provincial and federal law. It is important that both documents are signed appropriately.

PERSONAL DIRECTIVE AND ENDURING POWER OF ATTORNEY

With DocPrep Services, the process is simple. I provide clients with a questionnaire for completion. Documents will be drafted based on the questionnaire and at this point, I leave it up to the clients as to whether they would prefer an in person meeting to discuss the drafts or we can continue our communication via email or telephone. Once the documents are finalized, there will be one final meeting for signing.
